Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services operated by Tinker Apps Inc. ("we," "us," or "our"), including TinkerTray (the "Services"). By accessing or using the Services, you agree to these Terms.

1. Eligibility and Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity that occurs under your account.

2. The Services

The Services may allow users to upload photos of craft supplies, submit prompts and preferences, receive AI-generated craft ideas, participate in community sharing features, and purchase credits or memberships.

3. User Content

You retain ownership of the content you submit, upload, or post through the Services ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, display, and use User Content as reasonably necessary to operate, improve, and provide the Services.

You represent that you have the rights needed to submit your User Content and that your User Content does not violate any law or the rights of others.

4. Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, fraudulent, or abusive purposes.
  • Upload content that infringes intellectual property, privacy, or other rights.
  • Post defamatory, harassing, or otherwise objectionable community content.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Services.
  • Reverse engineer or misuse the Services except as allowed by applicable law.

5. AI-Generated Content

Craft ideas and other outputs generated through the Services may be produced using artificial intelligence and may not always be accurate, complete, safe, or suitable for your situation. You are responsible for reviewing generated content before relying on it, especially where children, tools, materials, allergies, or safety considerations are involved.

6. Credits, Memberships, and Payments

Certain features may require paid credits or memberships. Prices, feature availability, and plan details may change. Unless otherwise stated, purchases are non-refundable except where required by applicable law.

7. Community Features

If you share content publicly, you understand that other users may view it. We may remove community content that violates these Terms or that we reasonably consider harmful, inappropriate, or inconsistent with the operation of the Services.

8. Intellectual Property

The Services, including our branding, software, designs, and underlying technology, are owned by Tinker Apps Inc. or its licensors and are protected by applicable intellectual property laws.

9. Termination

We may suspend or terminate access to the Services if you violate these Terms, create risk for us or others, or where necessary for legal or operational reasons. You may stop using the Services at any time.

10. Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, or that the Services will meet every expectation or requirement.

11. Limitation of Liability

To the fullest extent permitted by law, Tinker Apps Inc. and its directors, officers, employees, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity arising from or related to the Services.

12. Indemnity

You agree to indemnify and hold harmless Tinker Apps Inc. from claims, liabilities, damages, losses, and expenses arising out of your User Content, your misuse of the Services, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of Manitoba and the applicable laws of Canada, without regard to conflict of law rules, unless applicable law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
